1. Scope
These Terms of Service apply to all orders placed through ever-tune.com for personalized digital songs provided by EverTune.
2. Subject of the Contract
EverTune provides personalized original digital songs based on information submitted by the customer in the order form. The final product is delivered digitally by email.
3. Contract Formation
The contract is concluded after a binding order and successful payment confirmation. The customer receives an order confirmation by email.
4. Prices and Payment
All prices shown during checkout are final prices including applicable taxes unless stated otherwise. Payment is processed via authorized third-party payment providers.
5. Delivery
Standard delivery is up to 5 business days after payment confirmation. If an express option is purchased, delivery is targeted within 24 hours.
6. Right of Withdrawal for Digital Personalized Content
For personalized digital content, the right of withdrawal may expire once performance has begun, provided the customer has expressly consented before checkout.
7. Refund Policy
If you are not satisfied, contact help@ever-tune.com within 30 days of delivery. We review each request individually and provide a fair resolution according to our refund policy.
8. Copyright and Usage Rights
The customer receives a non-transferable license for personal use. Commercial use, resale, or public performance requires prior written permission.
9. Content Creation Process
Song composition, lyrics structuring, and vocal rendering may be produced with the support of proprietary automated systems. Outputs are generated uniquely per order from customer-provided text inputs.
We do not intentionally clone, impersonate, or recreate the identity of real artists or private individuals. We also do not require biometric inputs such as voice samples or facial data.
While each order is generated as an original output, we cannot guarantee the absolute absence of coincidental similarities to existing works.
10. Liability
Liability is limited to cases of intent, gross negligence, and mandatory legal obligations. In all other cases, liability is limited to foreseeable, contract-typical damages.
11. Data Protection
Information on data processing is available in our privacy policy.
12. Final Provisions
If any provision of these terms is invalid, the remaining provisions remain unaffected.
